1. Introduction

Welcome to DAR SORA. These Terms of Service ("Terms") govern your access to and use of the DAR SORA website, mobile experience, and all related services (collectively, the "Services") operated by DAR SORA.

By accessing or using our Services, placing an order, or creating an account, you confirm that you have read, understood, and agree to be bound by these Terms in full. If you do not agree to these Terms, please do not use our Services.

These Terms are governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia, including but not limited to:

  • The E-Commerce Law (Royal Decree No. M/71)
  • The Consumer Protection Law (Royal Decree No. M/30)
  • The Anti-Cyber Crime Law (Royal Decree No. M/17)
  • The Personal Data Protection Law (Royal Decree No. M/19)
  • The Electronic Transactions Law (Royal Decree No. M/18)

2. Eligibility

By using our Services, you represent and warrant that:

  • You are at least 18 years of age, the age of majority in the Kingdom of Saudi Arabia.
  • You have the legal capacity to enter into a binding agreement.
  • You are not prohibited from using our Services under any applicable law.
  • If you are purchasing on behalf of a company or organization, you have the authority to bind that entity to these Terms.

DAR SORA reserves the right to refuse service, cancel orders, or terminate accounts at our discretion if we have reason to believe eligibility requirements are not met.

3. Account Registration

  • You may be required to create an account to access certain features of the Services.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
  • You agree to provide accurate, current, and complete information during registration and to update it as necessary.
  • You must notify us immediately at info@dar-sora.com if you suspect any unauthorized use of your account.
  • DAR SORA will not be liable for any loss or damage arising from your failure to protect your account credentials.
  • We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for an extended period.

4. Products and Services

  • All products displayed on our website are subject to availability. We reserve the right to discontinue any product at any time without notice.
  • Product images, descriptions, and colors are displayed as accurately as possible. However, we cannot guarantee that your device screen will accurately reflect the true color or appearance of our products. Slight variations may occur.
  • All products sold by DAR SORA are described as accurately as possible in accordance with Article 4 of the Saudi E-Commerce Law, which requires accurate and complete product information to be provided to the consumer prior to purchase.
  • DAR SORA reserves the right to limit the quantities of any product available for purchase.

5. Pricing and Payment

  • All prices are displayed in Saudi Riyals (SAR) and include applicable VAT where required by Saudi law.
  • DAR SORA reserves the right to change prices at any time without prior notice. Price changes will not affect orders that have already been confirmed.
  • In the event of a pricing error on our website, we reserve the right to cancel any affected orders and issue a full refund. We will notify you promptly if this occurs.
  • We accept the following payment methods: Mada, Visa, Mastercard, Apple Pay, and any other methods displayed at checkout.
  • All payments are processed securely. DAR SORA does not store your full payment card details on our servers.
  • By placing an order, you confirm that you are authorized to use the payment method provided.

6. Value Added Tax (VAT)

  • DAR SORA complies with the VAT regulations of the Kingdom of Saudi Arabia as administered by the Zakat, Tax and Customs Authority (ZATCA).
  • Where applicable, VAT at the current rate will be applied to your order and displayed clearly at checkout.

7. Order Confirmation and Contract Formation

  • Placing an order on our website constitutes an offer to purchase the selected products under these Terms.
  • A binding contract between you and DAR SORA is formed only when you receive an order confirmation email from us acknowledging acceptance of your order.
  • We reserve the right to refuse or cancel any order at any time before dispatch for reasons including but not limited to product unavailability, payment failure, suspected fraud, or pricing errors.
  • If we cancel your order after payment has been received, we will issue a full refund within 7 business days.

8. Delivery

  • DAR SORA will deliver your order within the timeframe communicated at the time of purchase, in accordance with Article 14 of the Saudi E-Commerce Law.
  • If we are unable to deliver within the stated timeframe due to circumstances within our control, you are entitled to cancel your order and receive a full refund.

9. Returns, Refunds and Exchanges

  • You have the right to return eligible items within 7 days of receipt, in accordance with the Saudi Consumer Protection Law and E-Commerce Law.
  • Full details of our return, refund, and exchange process are set out in our Return and Refund Policy, which forms part of these Terms.
  • Nothing in these Terms limits or excludes your statutory rights as a consumer under Saudi law.

10. Intellectual Property

  • All content on the DAR SORA website, including but not limited to text, images, photographs, graphics, logos, icons, designs, product names, and brand identity, is the exclusive property of DAR SORA and is protected under the Intellectual Property Laws of the Kingdom of Saudi Arabia.
  • You may not reproduce, distribute, modify, display, publish, transmit, or create derivative works from any content on our website without our prior written permission.
  • The DAR SORA name, logo, and brand identity are trademarks of DAR SORA. Unauthorized use of our trademarks is strictly prohibited.

11. Prohibited Use

By using our Services, you agree not to:

  • Use the Services for any unlawful purpose or in violation of any applicable Saudi or international law.
  • Engage in any conduct that is fraudulent, deceptive, or misleading.
  • Attempt to gain unauthorized access to any part of the Services, our servers, or any systems connected to the Services, in violation of the Saudi Anti-Cyber Crime Law (Royal Decree No. M/17).
  • Transmit any viruses, malware, or other harmful code through the Services.
  • Harvest, scrape, or collect personal information about other users without their consent.
  • Use any automated tools, bots, or scripts to access or interact with the Services without our prior written permission.
  • Post, upload, or transmit any content that is defamatory, offensive, obscene, or violates the rights of any third party.
  • Impersonate DAR SORA, its employees, or any other person or entity.
  • Use the Services in any way that could damage, disable, overburden, or impair our website or servers.

Violations of these prohibitions may result in immediate termination of your account and may be reported to the relevant Saudi authorities, including the Saudi Authority for Intellectual Property and CITC where applicable.

12. User-Generated Content

  • If you submit reviews, comments, photos, or any other content to our website or social media channels, you grant DAR SORA a non-exclusive, royalty-free, perpetual, and worldwide license to use, display, reproduce, and distribute that content in connection with our Services and marketing.
  • You represent that you own or have the right to submit such content and that it does not infringe any third-party rights.
  • DAR SORA reserves the right to remove any user-generated content at our discretion without notice.

13. Privacy

Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to the collection and use of your personal information as described in our Privacy Policy, in accordance with the Saudi Personal Data Protection Law (PDPL).

14. Disclaimers and Limitation of Liability

  • The Services are provided on an "as is" and "as available" basis. DAR SORA makes no warranties, express or implied, regarding the availability, accuracy, or reliability of the Services.
  • To the fullest extent permitted by Saudi law, DAR SORA shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Services.
  • Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under Saudi law.
  • DAR SORA's total liability to you for any claim arising from these Terms or your use of the Services shall not exceed the total amount paid by you for the order giving rise to the claim.

15. Force Majeure

DAR SORA shall not be liable for any delay or failure to perform our obligations under these Terms where such delay or failure results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, civil unrest, government action, labor disputes, pandemics, or disruption to third-party logistics or technology services. We will notify you as soon as reasonably possible and will work to resume performance at the earliest opportunity.

16. Amendments to These Terms

  • DAR SORA reserves the right to update or amend these Terms at any time.
  • We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date.
  • Your continued use of the Services after any amendment constitutes your acceptance of the updated Terms.
  • If you do not agree to the updated Terms, you must stop using the Services.

17. Governing Law and Dispute Resolution

  • These Terms are governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia.
  • Any dispute arising out of or in connection with these Terms or your use of the Services shall first be referred to DAR SORA for resolution by contacting us at info@dar-sora.com. We will attempt to resolve any dispute within 15 business days.
  • If we are unable to resolve the dispute directly, it shall be submitted to the competent courts of the Kingdom of Saudi Arabia in accordance with applicable law.
  • You also have the right to file a complaint with the Consumer Protection Authority (CPA) at cpa.gov.sa or by calling 1900.

18. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a competent court, that provision shall be deemed severed from the remaining Terms, which shall continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, Return and Refund Policy, and Shipping Policy, constitute the entire agreement between you and DAR SORA with respect to your use of the Services and supersede all prior agreements, representations, and understandings.
